ORDER ACCEPTANCE POLICY
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. CosmicPC.com reserves the right at any time after receipt of your order to accept or decline your order for any reason. CosmicPC.com reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over $1,500.00 ( BSD/USD ) must obtain pre-approval with an acceptable method of payment, as established by our credit department. We may require additional verifications or information before accepting any order. CosmicPC.com is a reseller to end user customers and does not accept orders from computer dealers, exporters, wholesalers, or other customers who intend to resell the products offered by CosmicPC.com.
RETURN POLICY AND LIMITED GUARANTEE AGAINST DEFECTS
Every third party product you buy from CosmicPC.com is backed first by the product manufacturer's warranty. Cosmic PC.com's 30 day limited warranty against defects, may also apply. Cosmic PC's 30 day limited warranty is a defective exchange policy that provides for either repair or replacement (at our sole discretion) of merchandise that has been confirmed as defective by either the manufacturer or CosmicPC.com. Leased merchandise is not eligible for this warranty. Due to licensing and copyright laws, we do not accept returns on software once a package has been opened. Defective software will be exchanged for the same title only according to Cosmic PC.com's limited 30 day warranty described above. Hardware confirmed as defective by the product manufacturer or CosmicPC.com will either be exchanged or repaired at our sole discretion within the first 30 days of ownership only. After 30 days the product manufacturer warranty is the only warranty in effect. Terms and conditions may vary by product or manufacturer. CosmicPC.com will assist customers whenever possible in gaining satisfaction with product manufacturers. For assistance or to exchange a defective product please return item to our store location. Products returned for exchange must be in new condition, original packaging and include all disks, registration cards, packing materials and other accessories and be received within 30 days of the invoice date. We reserve the right to refuse for return or charge a restocking fee for damaged or incomplete returns. No returns will be accepted without an RA number issued by CosmicPC.com or when the product manufactures or distributors return policies supersede ours.
COSMICPC.COM'S PRICE GUARANTEE
Cosmic PC.comís point of sale price match policy: At point of sale we will match any local competitorís price on identical offers or items. The item must be in-stock, available for immediate shipment and be in the same condition as the CosmicPC.com advertised item. Price matched items are limited to one per household. Sorry, but we do not offer price matches on any item that is advertised below Cosmic PCís actual cost.
CosmicPC.comís 30 day price protection policy: In the event our advertised price on an item falls within 30 days of your purchase date simply E-Mail us within 30 days of your original purchase date and we will issue you a Cosmic PC Credit in the amount of the price drop good toward the purchase of anything else we sell. Due to fluctuations in the industry, CPUís, Memory, and products or bundles containing a CPU or Memory (ex. Desktop and laptop computers) are not included in our price protection policy. Prices on CPU and Memory are subject to frequent change and we cannot offer price protection on these items and products containing these items in the event prices rise or fall.
Bundled items are included while supplies last. Items of similar or greater value may be substituted.
LIMITATION OF LIABILITY
In no event shall CosmicPC.com be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits.
Your order is thoroughly reviewed by our Credit Card Department to ensure that the order is accurate, the payment method is valid, and you are authorized to use this payment method. Once your order has passed the rigorous review by our Credit Card Department, it will be processed and prepared for shipment.
Please note, credit card processing can take up to 3 business days (Depending on the accuracy of the information given to us by the customer.). Further, for security reasons, voice confirmation may be required before we can process your credit card for payment.
If the item(s) on your order are in-stock, we will deliver them as soon as possible from our store location or warehouse or from one of our Distribution Warehouses located throughout the United States. If the item(s) on your order are out of stock, they will not be shipped until we have received and processed the backordered inventory in our warehouse.
Next Day Shipping - All orders of products in stock at our store location in Nassau that are placed and processed by 1PM Monday Ė Friday will be received next day.
Standard Shipping - All orders of products in stock at our US warehouses that are placed and processed by 12Noon Monday Ė Friday will be received between 3-5 business days after the order is processed.
Expedited Shipping - In-stock warehouse items can be expedited at an additional cost to customers who wish to receive orders outside of our regular shipping schedules.
CosmicPC.com will not be liable for any loss, inconvenience, indirect, special, incidental or consequential damages caused to due to any delay in shipping.
All orders over $750 are subject to free delivery, all other orders if delivered, will be subject to a $35 delivery fee which must be selected online at the time the order is placed. CosmicPC.com will contact the customer when orders have arrived and it is the customerís obligation to pick up their orders within 5 business days, otherwise, a daily storage fee of $5 will be charged. Any items not picked up after 45 days will be re-sold and the customer will not be refunded.
Sunday deliveries are not available.
TOTAL TIME FOR DELIVERY
Total time is based on the amount of time it takes to get payment authorization, order processing, and the transit time from the carrier. This can range from 24 hours to 10 days for warehouse in-stock items.
The delivery time for all backordered items will vary and will not always be clearly defined, as some items will come directly from the manufacturer. CosmicPC.com will not take responsibility for severely delayed back order shipments. CosmicPC.com will notify customers when backordered items have shipped, at which time the customerís credit card will be charged.
SHIPPING AND HANDLING RATES
Our customer-friendly shipping schedule is calculated on the ACTUAL WEIGHT of your shipment and the TYPE OF SHIPPING SERVICE that you specify (next day/standard/express). Shipping and handling charges will be applied to all orders placed with us. If your order must be shipped in multiple boxes, or in separate shipments in the event an item is not in stock and must ship at a later date, shipping and handling charges for the entire order will be assessed at the point when the first item is shipped. Credit / Debit Card Authorizations
An authorization on a credit or debit card is a hold against your bankís credit card spending limit. When the goods are shipped, a charge for the total amount of the order shipped will be sent to your credit card bank. Your bank should release the authorization when the charge is received. A charge is the only time a transfer of funds is completed; an authorization is not a transfer of funds.
RISK OF LOSS
If the Customer provides CosmicPC.com with Customer's carrier account number or selects a shipping method other than what Cosmic PC offers, title to products and risk of loss or damage during shipment passes from CosmicPC.com to Customer upon shipment from CosmicPC.com's shipment warehouse. For all other shipments, title to products and risk of loss or damage during shipment passes from CosmicPC.com to Customer upon receipt by Customer. Notwithstanding the foregoing, title to software will remain with the applicable licensor(s) and Customer's rights therein are contained in the license agreement between such licensor(s) and Customer. CosmicPC.com retains a security interest in the products until payment in full is received. Customer will be responsible for all shipping and related charges.
AGREEMENT TO RESOLVE ALL DISPUTES THROUGH ARBITRATION OR IN SMALL CLAIMS COURT AND AGREEMENT TO WAIVE A RIGHT TO JURY TRIAL AND TO PARTICIPATION IN CLASS ACTIONS
You and CosmicPC.com agree to resolve any controversy, dispute, or claim arising out of or relating to your purchase of any product or service from CosmicPC.com by binding Arbitration, or in a small claims court, and judgment on the arbitration award rendered by the Arbitrator(s) may be entered in a court having competent jurisdiction. This agreement to arbitrate is intended to be broadly interpreted and covers all controversies, disputes, claims arising out or relating to your purchase including, but not limited to contract claims, tort claims and statutory claims, or any combination of claims. We agree that the arbitration or small claim proceeding will take place in Nassau, Bahamas.
This Arbitration Agreement affects your legal rights. Arbitration is resolved by a neutral party and not a judge or jury. There is less discovery and less exchange of information between the parties to an arbitration than might occur in a court proceeding. An arbitration award is final and binding and will only be overturned or reversed by a court in very limited circumstances. You agree that, by entering into this Agreement, you and CosmicPC.com are each waiving the right to a trial by jury or to participate in a class action.
Your privacy is extremely important to us. We realize how important peace of mind is to the web user, and to that end, we have included this information for your benefit.
We do not track user names, email addresses or other personal information as you browse our site. However, we maintain a log of your IP address to gain an understanding of where our users are coming from, and where they go within our site. We also track which browser you use and the operating system you are running, information that is readily available in any web connection. Your IP address, browser preference, and OS choices are in no way linked to any other personal information.
